Aviso de Privacidad / Privacy Policy

En  cumplimiento  de  lo  dispuesto  por  la  Ley Federal de Protección de Datos Personales en 

Posesión de los Particulares (la "Ley") y demás ordenamientos  que  regulan  la  materia, 

Innovia Films México S.A. de C.V.  (de  ahora  en adelante  denominada  “INNOVIA FILMS”),  con domicilio en Colorines 255, Centro, 58600 Zacapu, Mich., asegurando la privacidad,  integridad, confidencialidad y el derecho a la autodeterminación informativa, se hace responsable del uso  y protección de  los datos personales proporcionados 

por usted en los términos aquí especificados. 

 

Información.‐

Los  datos  personales  que proporcione a INNOVIA FILMS, ya sea mediante  nuestra página de Internet, correo electrónico, por escrito y/o vía 

telefónica, o al identificarse en nuestra caseta de vigilancia, serán objeto de protección. 

 

Los  datos  que  podemos  obtener  por  estos medios son:  

 

A. Proveedores: su nombre, nacionalidad, domicilio,  teléfono,  fax,  correo  electrónico,  página  de  Internet, 

registro  federal  de  contribuyentes, puesto,  departamento  y  datos financieros  (información 

bancaria  y declaración anual de impuestos). 

 

B. Clientes: su  nombre,  nacionalidad, domicilio,  teléfono,  fax,  correo electrónico,  registro  federal  de 

contribuyentes  y  datos  financieros (últimos dígitos de su cuenta bancaria para poder revisar sus 

transferencias). 

 

C. En  nuestra  Caseta  de  Vigilancia,  le solicitaremos  nos  proporcione  los siguientes datos: 

 

‐ Su nombre. 

‐ Una  identificación  oficial,  que  puede contener su nombre, domicilio, edad, sexo, nacionalidad, registro federal de contribuyentes y CURP. 

‐ Asimismo,  le  tomaremos  una fotografía. 

 

Los  datos  personales  que  nos  sean proporcionados por usted, de conformidad con la  Ley,  se 

guardarán  en  bases  de  datos confidenciales  y  con  acceso  limitado, comprometiéndonos  a 

que  los  mismos  sean tratados  bajo  las  más  estrictas  medidas  de seguridad que garanticen su confidencialidad. 

 

Finalidad  de  uso  de  información.‐  La información  proporcionada  como  datos personales 

(incluidos  los  financieros,  en  caso aplicable)  será  utilizada  para  las  siguientes finalidades: 

 

A) Proveedores: utilizada para la compra, facturación  (pago),  embarque  y recepción 

de sus productos,  así  como para darlo de alta en nuestra base de datos. 

 

B) Clientes: para  la  facturación, seguimiento de cobranza, embarque y 

entrega  de  sus  productos,  envío  de boletines y de encuestas, así como para darlo de alta en 

nuestra base de datos. 

 

C) Caseta  de  Vigilancia: La  información proporcionada  como datos personales 

será  utilizada  únicamente  para identificarlo  al  accesar  a  nuestras instalaciones. 

 

 

Todos  los  interesados  que  hayan proporcionado sus datos personales (incluidos los financieros, en caso aplicable), tendrán los derechos de acceso, rectificación, cancelación u oposición 

(Derechos "ARCO") establecidos en la Ley y los demás ordenamientos que regulan la materia.  Esto  quiere  decir  que  usted tiene  el derecho de acceder a sus datos personales y a los detalles del 

tratamiento de los mismos, asícomo a rectificarlos en caso de ser inexactos o instruirnos  cancelarlos cuando considere queresulten ser  excesivos o  innecesarios para  las 

finalidades  que  justificaron su  obtención,  con las exclusiones establecidas en el Artículo 26 de 

la Ley, u oponerse al tratamiento de los mismos para fines específicos.  

 

Contacto.‐ La solicitud de acceso, rectificación, cancelación  u  oposición,  o su  revocación  de 

consentimiento,  deberá  de  ser  enviada  al correo electrónico Alberto.rodriguez@innoviafilms.com o a nuestras  oficinas  ubicadas  en Colorines 255, Centro, 58600 Zacapu, Mich.

 

Derechos  "ARCO".‐ La  solicitud  de  acceso, rectificación,  cancelación  u  oposición,  o  su 

revocación  de  consentimiento,  deberá contener su nombre y domicilio completo o, en 

su  caso,  los  datos  del  representante  legal, asimismo, se deberá especificar el medio para 

recibir  notificaciones  y,  en  forma  clara,  los datos personales a  los que solicita su  acceso, 

rectificación,  cancelación  u  oposición, indicando  los  motivos  por  los  cuales  desea 

acceder  a sus  datos  personales  o  las razones por las que sus datos deben ser rectificados o 

cancelados.  Acompañando  a  la  solicitud,  se debe  presentar  una  identificación  oficial  para 

acreditar su personalidad y en caso de tratarse de un representante  legal, el documento que 

acredite su personalidad. De conformidad con el  artículo  32  de  la  Ley,  el  departamento 

encargado de sus datos personales tendrá un plazo  de  20  días  hábiles,  a  partir  de  la 

recepción de la solicitud, para dar respuesta al trámite. Dicho plazo podrá ser ampliado por un 

periodo  de  tiempo  igual,  notificando  las razones de dicha ampliación por el medio que 

usted haya indicado para tales efectos.  

 

Transferencia  a filiales y terceros.‐ INNOVIA FILMS podrá compartir su información (incluida la 

financiera, en caso aplicable) en los siguientes casos: 

 

A. Proveedores: INNOVIA FILMS podrá compartir  su  información  (incluida  la 

financiera,  en  caso  aplicable)  con sus sociedades  afiliadas,  subsidiarias  y/o 

controladoras,  terceros,  agentes, contratistas o socios cuando realicen a 

favor  de  o  directamente  con INNOVIA FILMS la  prestación  de  sus 

servicios o con la finalidad de transmitir información relativa  a  pagos  (cuentas 

por  pagar),  actualizar  bases  de  datos y/o en  caso de que dichas sociedades  

afiliadas,  subsidiarias  y/o controladoras,  terceros,  agentes, 

contratistas o socios quieran contratar al  proveedor.  Dichas  sociedades  

afiliadas,  subsidiarias  y/o controladoras,  terceros,  agentes, 

contratistas  o  socios  se  encuentran restringidos  de  utilizar su  información 

personal  para  cualquier  objetivo distinto  al  mencionado 

anteriormente. Asimismo INNOVIA FILMS podrá transferir su  información  a 

agentes  aduanales,  con  la  exclusiva finalidad de que éstos lleven a cabo la 

clasificación,  captura  y  despacho  de pedimentos. 

 

B. Clientes:INNOVIA FILMS podrá compartir  su  información  (incluida  la 

financiera,  en  caso  aplicable)  con sus sociedades  afiliadas,  subsidiarias  y/o 

controladoras,  terceros,  agentes, contratistas o socios cuando realicen a 

favor  de  o  directamente  con INNOVIA FILMS la  prestación  de  sus 

servicios o con la finalidad de transmitir información relativa  a  pagos  (cuentas 

por  cobrar),  actualizar bases de datos y/o en  caso de que dichas sociedades  

afiliadas,  subsidiarias  y/o controladoras,  terceros,  agentes, 

contratistas  o socios  quieran  celebrar contratos  con  el  cliente.  Dichas 

sociedades    afiliadas, subsidiarias  y/o controladoras,  terceros,  agentes, 

 contratistas  o socios se encuentran restringidos  de utilizar su información

personal  para  cualquier  objetivo distinto al mencionado anteriormente. 

Asimismo, INNOVIA FILMS podrá transferir  su  información  a  agentes 

aduanales, con la exclusiva finalidad de que éstos lleven a cabo la clasificación, 

captura y despacho de pedimentos. 

 

Nos  comprometemos  a  no  transferir  su información a terceros distintos a los indicados 

anteriormente, sin su consentimiento, salvo las excepciones  previstas  en  el  artículo  37  de  la 

Ley. 

 

INNOVIA FILMS se  abstendrá  de  vender, arrendar  o  alquilar  los  datos  personales 

(incluidos  los  financieros)  que  nos  son proporcionados por usted a terceros. 

 

Modificaciones  al  aviso  de  privacidad.‐ INNOVIA FILMS se  reserva  el  derecho  de 

cambiar  el  presente  Aviso  de  Privacidad  en cualquier momento. En caso de que se realice 

algún  cambio  al  Aviso  de  Privacidad,  se  le comunicará  a  través  de  nuestra  página  de 

Internet. 

 

Consentimiento.‐ Se  entenderá  que  usted  ha  leído,  conoce  y acepta  las  condiciones 

establecidas  en  este Aviso de Privacidad, y consiente tácitamente el tratamiento  de sus  datos 

personales  para  los que  no  se  requiere  consentimiento  expreso cuando  habiéndose  puesto  a  disposición  este Aviso de Privacidad, no manifiesta oposición al mismo.

PRIVACY NOTICE

 

In compliance with the Federal Law for Protection of Personal Data in Possession of Private Individuals/Entities ("Law") and its regulations, we inform you that Innovia Films México S.A. de C.V., (here in after “INNOVIA FILMS”), with its registered office at Av. Michoacán No. 20 Módulo 21, Col. Renovación, Deleg. Iztapalapa, C.P. 09209, México, City, ensuring the privacy, integrity, confidentiality and the right of informative self determination, is responsible of the use and protection of personal data provided by you in the terms specified herein.

 

Information.‐ The personal data provided by you to INNOVIA FILMS, either through our website, via e‐mail, by writing and/or by telephone, or when you identify yourself at our Surveillance Booth, will be protected.

 

The data that we may obtain by this means are:

 

A. Suppliers:your name, nationality, address, telephone number, fax number, e‐mail, website, tax id number, post, department, and financial data (banking information and annual tax return).

 

B. Clients:your name, nationality, address, telephone number, fax number, e‐mail, tax id number and financial data (last digits of your banking account in order to review transfers).

 

C. In our Surveillance Booth, we will request you the following data:

‐ Yourname

‐ An official id that can contain: your name, address, age, sex, nationality, tax id number and CURP.

‐ We might also take you a photograph.

 

The personal data provided by you in accordance with the Law, will be stored in confidential databases with limited access. We commit ourselves that they will be treated with the most stringent security measures in order to ensure their confidentiality.

 

Intended use of information.‐ The information provided as personal data (including financial data, if applicable) will be used for the following:

 

A) Suppliers:the purchasing, billing (payment), shipping and receiving of your products, as well as in order to include you in our database.

 

B) Clients:billing, shipping and delivery of your products, as well as well as to send you newsletters and surveys, and to include you in our database.

 

C) Surveillance Booth:The information provided as personal data will be used only in order to identify you at our offices.

 

All persons who have provided their personal data (including financial data, if applicable) will have the rights of access, rectification, cancellation or opposition (“ARCO” Rights), established in the Law and its regulations. This means that you have the right to access your personal data and the details of the treatment of your information, as well as to rectify it if the information is inaccurate, or instruct us to cancel it if you consider it is excessive or unnecessary for the purposes for which it was provided, with the exclusions set forth in Article 26 of the Law, or oppose the treatment of your personal data for specific purposes.

“ARCO” Rights.‐ The request for access, rectification, cancellation or opposition, or your revocation of consent, must include your full name and address or, if applicable, the legal representative data. It must also specify the means for receiving notifications and, in a clearly way, the personal data for which you request access, rectification, cancellation or opposition, establishing the reasons for which you wish to access your personal information or the reasons why your data should be rectified or canceled. With the request, you must present an official ID, and in case of a legal representative, he must present the document that states he is acting on behalf of the Corporation/individual. In accordance with Article 32 of the Law, the department in charge of your personal data has a period of 20 working days counted from the receipt of the request in order to answer the procedure. This period may be extended for an equal period of time, notifying the reasons for the extension by the means you have indicated for this purpose.

 

Transference to affiliates and third parties.‐ INNOVIA FILMS will be allowed to share your information (including financial data, if applicable), in the following cases:

 

A. Suppliers: INNOVIA FILMS will be allowed to share your information (including financial data, if applicable)with its affiliates, subsidiaries and/or controllers, third parties, agents, contractors or partners when they provide their services to INNOVIA FILMS with the purpose of submitting information regarding payments (pending accounts), updating databases and/or in case these affiliates, subsidiaries and/or controllers, third parties, agents, contractors or partners want to celebrate agreements with the supplier. These affiliates, contractors, third parties and/or partners, will not use your personal data for any purpose different to ones established above. In addition, INNOVIA FILMS may transfer your information to customs agents, with the exclusive purpose of carrying out the classification, capture and dispatch of products.

 

B. Clients: INNOVIA FILMS will be allowed to share your information (including financial data, if applicable) with its affiliates, subsidiaries and/or controllers, third parties, agents, contractors or partners when they provide their services to INNOVIA FILMS, or with the purpose of submitting information regarding payments (pending accounts), updating databases and/or in case these affiliates, subsidiaries and/or controllers, third parties, agents, contractors or partners want to celebrate agreements with the client. These affiliates, contractors, third parties and/or partners, will not use your personal data for any purpose different to ones established above. In addition, INNOVIA FILMS may transfer your information to customs agents, with the exclusive purpose of carrying out of carrying out the classification, capture and dispatch of products.

 

INNOVIA FILMS agrees not to transfer your personal data to third parties different to the ones established in the preceding paragraph, except in the cases established in Article 37 of the Law.

 

INNOVIA FILMS will not sell nor lease your personal data (including financial and/or data) provided by you to third parties.

 

Changes of the Privacy Notice.‐ INNOVIA FILMS reserves the right to change this Privacy Notice

at any time. If any change is made to the Privacy Notice, you will be notified through our website.

 

Consent.‐ It is understood that you have read, understand and accept the terms of this Privacy Notice, and tacitly consent the treatment of your personal data that does not require explicit consent when, having made available this Privacy Notice, you raise no objection.
